వక్ఫ్ ఆస్తుల అమ్మకానికి అంతా సిధ్ధం!

ముస్లిం సమాజానికి చెందిన వక్ఫ్ భూముల్ని అమ్మివేయడానికి ఆంధ్రప్రదేశ్ ప్రభుత్వం మరొక్కసారి సిధ్ధమయింది. ప్రజలు ఎన్నికల కోలాహలంలో మునిగి వున్నప్పుడే ఆ పని గుట్టుచప్పుడు కాకుండా పూర్తి చేసేయాలని ప్రభుత్వ వున్నతాధికారులు, అధికార పార్టి పెద్దలు కుట్రలు చేస్తున్నారు.  గుంటూరు జిల్లా మంగళగిరి మండలం  కాజా గ్రామంలోని అషూర్ ఖానా  భూముల అమ్మకానికి సన్నాహాలు పూర్తి అయ్యాయి. ముఖ్యమంత్రి కుమారుడు రాష్ట్ర ఐటి, పంచాయత్ రాజ్ శాఖల మంత్రి నారా లోకేష్ ప్రస్తుతం మంగళగిరి నియోజకవర్గం నుండే పోటిచేస్తూ వుండడం విశేషం.

గుంటూరుతో పాటూ   నెల్లూరు, అనంతపురం, కడప జిల్లాలోని వక్ఫ్ భూముల్ని సహితం అమ్మడానికి ప్ఫైళ్ళు కదులుతున్నాయని నమ్మకమైన సమాచారం. వేలాది కోట్ల రూపాయలు విలువ చేసే  ముస్లిం సమాజపు ఆస్తుల్ని ‘నిరర్ధక ఆస్తుల క్రమబద్దీకరణ’ సాకుతో అమ్మివేసే ప్రక్రియ వుధృతంగా సాగుతోంది. “చచ్చినోడి  పెళ్ళికి వచ్చిందే  కట్నం” అనేది వాళ్ళ వాదన.   

వితరణశీలురయిన ముస్లిం సంపన్నులు తమ స్థిరాస్థిలో కొంత భాగాన్నో లేదా మొత్తం ఆస్తినో ‘అల్లా’ పేరున రాసేస్తారు. ఈ ప్రక్రియను ఇస్లాం సాంప్రదాయంలో వక్ఫ్ చేయడం అంటారు.  ఒకసారి వక్ఫ్ చేసిన ఆస్తిని తిరిగి తీసుకోవడం కుదరదు. అమ్మడమూ కుదరదు. దాత సంతతికి చెందినవారికి  కూడ  దాని మీద ఎలాంటి హక్కులు వుండవు. ఆ స్థిరాస్తుల్ని పరిరక్షిస్తూ ఇస్లామిక్ ధార్మిక కార్యక్రమాలకు ముస్లిం సమాజంలోని నిరుపేదల సంక్షేమానికి  వినియోగించాలనేది వక్ఫ్  సాంప్రదాయం లక్ష్యం. 1956లో ఉమ్మడి ఆంధ్రప్రదేశ్ ఏర్పడేనాటికి రాష్ట్రంలో మూడు లక్షల ఎకరాల వక్ఫ్ భూములున్నాయని అంచన. 

ఆర్ధిక నిపుణుల అంచనా ప్రకారం రాష్ట్ర ప్రభుత్వం మైనారిటీల సంక్షేమం కోసం సాలీన బడ్జెట్ లో కేటాయించే  నిధులకన్నా అనేక రెట్లు ఎక్కువ ఆదాయం వక్ఫ్ ఆస్తుల ద్వార రాబట్టే అవకాశం వుంది. అయితే, వక్ఫ్ ఆస్తుల్ని సద్వినియోగం చేసే దృక్పథంగల నాయకత్వం ముస్లింలలో లోపించడం, ముస్లింలలో నిరక్షరాశ్యత, న్యాయస్థానాల్లో వాజ్యాలు నడిపే ఆర్ధిక స్తోమత లేకపోవడం, ప్రభుత్వాల నిర్లక్ష్యం,   ముస్లిం సమాజం మీద అధికారుల చిన్నచూపు, క్షేత్రస్థాయిలో పోలీసులు కబ్జాదారుల పక్షాన నిలబడడం తదితర కారణాలవల్ల వక్ఫ్ భూములు పెద్ద ఎత్తున అన్యాక్రాంతం అయిపోయాయి; అయిపోతున్నాయి.  

చంద్రబాబు నాయుడు  హైదరాబాద్ లో తాను సైబరాబాద్ ను  నిర్మించినట్టు తరచూ గొప్పగా చెప్పుకుంటుంటారు. అయితే, హైటెక్ సిటీ నిర్మాణానికి బలిపెట్టింది ఎక్కువ భాగం వక్ఫ్ భూముల్నే!  విశాఖపట్నంలో కూడా హజ్రత్ ఇషాక్ రహమతుల్లా అలై  దర్గాకు చెందిన 3500 ఎకరాలు కార్పొరేట్ సంస్థలకు పంచిన ఘనతా వారిదే.

2005లో అప్పటి మైనారిటీల సంక్షేమ శాఖా మంత్రి ముహమ్మద్ ఫరీదుద్దీన్ శాసన సభలో ఒక ప్రకటన చేస్తూ రాష్ట్రంలో దాదాపు 50 వేల ఎకరాల వక్ఫ్ భూములు  అన్యాక్రాంతం అయ్యాయని ప్రకటించారు. ఆక్రమణ దారుల్ని తొలగించి ఆ భూముల్ని తిరిగి స్వాధీనం చేసుకునే ప్రక్రియను ఆరంభిస్తామన్నారు.

కాజా గ్రామం రెవెన్యూ సర్వే నెంబరు 287-1లో 11 ఎకరాల 34 సెంట్లు, సర్వే నెంబరు 287-5లో 2 ఎకరాల 6 సెంట్ల భూములున్నాయి. మొత్తం  13 ఎకరాల 40 సెంట్ల భూముల్ని వందేళ్ళ క్రితం ముస్లిం దాతల బృందం ఒకటి ధార్మిక దానం (వక్ఫ్)గా ఇచ్చారు. మసీదు, ఆషూర్ ఖానా, దర్గా ల నిర్మాణం కోసం, అంజుమన్, మొహర్రం, దర్గా, మసీదుల నిర్వహణ వ్యయం తదితరాల కోసం షేక్ అహ్మద్ సాహెబ్, షేక్ అబ్దుల్ ఖాదర్, షేక్ రహీమ్ సాహెబ్, ఖాశిం సాహెబ్, మస్తాన్ సాహెబ్ తదితర వితరణశీలురు ఈ భూముల్ని ఇచ్చారు. ఆ వివరాలు జూన్ 28, 1962 నాటి ఆంధ్రప్రదేశ్ గెజిట్ దస్త్రాల్లో నమోదు కూడా అయ్యాయి.

ముస్లిం సమాజపు నిస్సహాయత, ప్రభుత్వ నిర్లక్ష్యం, వక్ఫ్ బోర్డు బాధ్యుల అవినీతి తదితర కారణాలవల్ల ఈ భూముల్లో కొంత రైల్వేశాఖ ఆక్రమించుకోగా, మరి కొంత భాగాన్ని స్థానికులు కొందరు ఆక్రమించు కున్నారు. ఆ భూముల్ని తమ పేరిట క్రమబధ్ధీకరించాలని ఆక్రమణదారులు గతంలో ప్రభుత్వానికి అర్జీలు పెట్టుకున్నారు. న్యాయస్థానాల్లో వాజ్యాలు కూడ నడిపారు. సీనియర్ లాయర్ ను పెట్టి కేసును పటిష్టంగా సాగించి వక్ఫ్ భూముల్ని తిరిగి స్వాధీనం చేసుకుని పరిరక్షీంచాలనే పట్టుదల ప్రభుత్వంలో లోపించడంతో  ఆ కేసులేవీ సఫలీకృతం కాలేదు.

 నెంబరు 5 చెన్నై- కోల్ కటా ఎక్స్ ప్రెస్‍ హైవే పక్కనే వుండడమే గాకుండా ఇటీవల ఆంధ్రప్రదేశ్ ఐటీ హబ్ కూడ అతి సమీపంలో నెలకొనడంతో కాజా  వక్ఫ్ భూములకు విపరీతమయిన గిరాకి పెరిగింది. ఇప్పుడు ఎకరా 10 కోట్ల రూపాయల పైమాటే అంటున్నారు. డీల్ 130 కోట్ల రూపాయల వ్యవహారంగా మారడంతో సచివాలం పెద్దల కన్ను ఇప్పుడు ఈ భూముల మీద పడింది. వాళ్లు ‘ప్రభుత్వ పంచాయితీ’ నడపడానికి నడుం బిగించారు. ఆంధ్రప్రదేశ్ లో  ప్రైవేటు పంచాయితీ అయినా,  ప్రభుత్వ పంచాయితీ అయినా తీర్పు ఒక్కటే. చేయుంచుకున్నోళ్ళకు, చేసిపెట్టినోళ్ళకు చెరి సగం. అదే ధర్మ తీర్పు!

ఆంధ్రప్రదేశ్ వక్ఫ్ బోర్డు ముఖ్య కార్యనిర్వాహక అధికారి (సిఇఒ) కొలువు, గాలిలో దీపం రెండూ ఒకటే.  గడిచిన మూడు నెలల్లో ముగ్గురు సిఇవోలను మార్చారు. ఈ ఒక్క రుజువు చాలు రాష్ట్ర వక్ఫ్ బోర్డులో ఎన్ని అవకతవకలు జరుగుతున్నాయో అంచనా వేయడానికి. వక్ఫ్ బోర్డులో అల్లా నామం జపిస్తారు. సచివాలయంలో శంకరా, గోపాల నామాలు జపిస్తారు. అందరూ పరమభక్తులే; వక్ఫ్ ఆస్తులు మాత్రం వేల ఎకరాలు హరించుకు పోతున్నాయి.

ఖాజా అషూరా ఖానా భూముల వ్యవహారం తేల్చేయండంటూ గత నవంబరు నెలలో సచీవాలయం నుండి రాష్ట్ర వక్ఫ్ బోర్డుకు ఆదేశాలొచ్చాయి. వక్ఫ బోర్డు ఛైర్మన్ జలీల్ ఖాన్ నవంబరు 13న రాష్ట్ర వక్ఫ్ బోర్డు సమావేశం నిర్వహించారు. ఆ భూమి అన్యుల ఆక్రమణలో వుండడం, న్యాయస్థానాలు కూడ అటుపక్షమే వుండడం,  ఆ భూముల మీద వక్ఫ్ బోర్డుకు ఆదాయం కూడా లేకపోవడం, అది నిరర్ధక ఆస్తిగా మారడం వంటి నైరాశ్యపు అభిప్రాయాలు బోర్డు సమావేశంలో వ్యక్తం అయ్యాయి.

   ఖాజా వక్ఫ్ భూముల వ్యవహారంపై వక్ఫ్ చట్టం – 1995 లోని సెక్షన్ 97 ప్రకారం రాష్ట్ర ప్రభుత్వం సముచిత నిర్ణయం తీసుకోవాలి” అంటూ బోర్డు ఒక తీర్మానం చేసింది. “నిజానికి ఇలాంటి వ్యవహారాల్లో బోర్డు పాత్ర నామమాత్రమే. సచీవాలయం లోని పెద్దలే తీర్మానాలు రాసి పంపుతారు. దాన్ని మేము ఆమోదిస్తాము. ఇది ఎప్పుడూ జరిగే తంతే” అని పేరు చెప్పడానికి ఇష్టపడని బోర్డు అధికారి ఒకరు అన్నారు.

సచివాలయం పెద్దలు తెలివైనవారు.  ఏ పని చేసినా రికార్డు మాత్రం సరిగ్గా వుండాలంటారు. వక్ఫ్ బోర్డు సమావేశానికి ముందే   సిఇవో యం.డి.  సుభానీ కాజా భూముల వ్యవహారంపై అక్టోబరు 9న న్యాయసలహా కోసం సీనియర్ అడ్వకేట్ పి. వీరా రెడ్డిని సంప్రదించారు. “కొన్ని ప్రత్యేక పరిస్థితుల్లో వక్ఫ్ చట్టం – 1995 లోని సెక్షన్ 97 మనకు సహాయకారిగా వుంటుంది. రాష్ట్ర ప్రభుత్వం, తాను సమంజసమని భావిస్తే, కొన్ని జటిల సమస్యల పరిష్కారానికి వక్ఫ్ బోర్డుకు దిశా నిర్దేశం చేసే అవకాశాన్ని ఈ సెక్షన్ కల్పిస్తుంది. అలా ప్రభుత్వం సూచించే మార్గదర్శకాలు అన్నింటినీ వక్ఫ్ బోర్డు   అమలు చేయాల్సి వుంటుంది” అని వీరా రెడ్డి న్యాయ సూక్ష్మాన్ని వివరించారు.

గతంలో ఉరిశిక్ష వేయగానే న్యాయమూర్తులు ఆ కలాన్ని విరగ్గొట్టే సాంప్రదాయం ఒకటి వుండేది. వక్ఫ్ బోర్డులోనూ అలాంటి సాంప్రదాయం ఒకటి కొనసాగుతోంది. కాజా భూముల వ్యవహారంలో F.No. S/19/ GNT/ 2018 లేఖ ద్వార డిసెంబరు 3న  సచివాలయానికి అనుకూల తీర్మానం  చేసి పంపగానే సిఇఒ యం.డి.  సుభానీని అక్కడి నుండి బదిలీ చేసేశారు. జనవరిలో ఇంకో సిఇఒ వచ్చారు. ఆయన ద్వార ఏ తీర్మానం చేయించి ఎక్కడ ఎన్ని భూములు అమ్మేశారోగానీ  నెల తిరక్కముందే వారిని మార్చేశారు. ఫిబ్రవరిలో షేక్ అహ్మద్ ను కొత్త సిఇఒగా నియమించారు. త్వరలో వారూ బదిలీ అయిపోతారని వక్ఫ్ బోర్డు ఆఫీసులో కొంచెం గట్టిగానే అనుకుంటున్నారు.

సాధారణంగా వక్ఫ్ ఆస్తుల్ని అమ్మడానికి వీలు లేదు. నిరర్ధక ఆస్తిగా మారిందనే నెపంతో ఒక ప్రత్యేక పరిస్థితిలో ప్రత్యేక నిర్ణయం తీసుకోవడానికి సెక్షన్ 97 ప్రభుత్వానికి అందుబాటులో వుండే పరికరం. బ్రహ్మాస్త్రం చేతికి చిక్కడంతో కాజా వక్ఫ్ భూముల్ని ‘పంచాయితీ ధర్మ తీర్పు’ ప్రకారం  క్రమబధ్ధం చేయడానికి సచివాలయం పెద్దలు నడుంబిగించారు.   ఆ వరసలో అనేక జిల్లాల వక్ఫ్ భూముల్ని అమ్మకానికి సిధ్ధం చేస్తున్నారు.

సారాంశం

కశ్మీర్ : రెండు అస్తిత్వాల ఘర్షణ

వైవిధ్య పూరిత సమాజంలో ప్రతి వ్యక్తికీ అనేక అస్తిత్వాలుంటాయి. అస్తిత్వవాద ఉద్యమాలు వుధృతంగా వున్నప్పుడు సమూహాలకు ఒక అస్తిత్వం మాత్రమే చురుగ్గా పని చేస్తూ వుంటుంది. మిగిలిన అస్తిత్వాలు నిద్రాణవస్థలో వుంటాయి.  

కశ్మీర్ లోయలోని వారికి రెండు అస్తిత్వాలు ఒకే సందర్భంలో చురుగ్గా వుంటాయి. మొదటిది; కశ్మీరి జాతి అస్తిత్వం.  రెండోది; ఆదివాసి / గిరిజన తెగ అస్తిత్వం. 

కశ్మీరిల  జాతి అస్తిత్వం  స్వయం నిర్ణయాధికారాన్నీ, పార్లమెంటరీ ప్రజాస్వామిక వ్యవస్థను కోరుకుంటోంది. కశ్మీరీల గిరిజన అస్తిత్వం  ప్రధాన స్రవంతి నుండి పరిరక్షణ కొరుకుంటుంది.  
 కశ్మీర్ ప్రజల ఈ  రెండు కోరికలను నెరవేర్చడానికి  ఇటు భారత దేశంగానీ అటు పాకిస్తాన్ గానీ ఎన్నడూ సిధ్ధంగా లేవు.

కశ్మీరీల్లో అత్యధికులు ముస్లింలు కావడం ఒక ధార్మిక అస్తిత్వం.   ఈ  మూడవ అస్తిత్వం  స్వీయ సమాజపు సాంస్కృతిక పరిరక్షణని కోరుకుంటోంది.

పార్లమెంటరీ ప్రజాస్వామిక వ్యవస్థను నిర్మించుకోవాలనే కశ్మీరి జాతి అస్తిత్వపు ప్రగాఢ  కోరికను అవకాశంగా మార్చుకుని జమ్ము కశ్మీర్ ను తనలో విలీనం చేసుకోవాలని భారతదేశం భావిస్తోంది. అయితే,  కశ్మీరీల  స్వయం నిర్ణయాధికార ఆకాంక్షను మాత్రం అది గుర్తించదలకపోగా తీవ్రంగా వ్యతిరేకిస్తోంది.  

మరోవైపు,  కశ్మీరిల ముస్లిం ధార్మిక అస్థిత్వాన్ని అవకాశంగా మార్చుకుని జమ్ము కశ్మీర్ ను తనలో విలీనం చేసుకోవాలని పాకిస్తాన్ ఆశిస్తోంది. రెండు దేశాల రెండు విరుధ్ధ ప్రయోజనాల మధ్య కశ్మీర్ లోయ నలిగిపోతోంది. కశ్మీరీ లోయలో అశాంతిని ఆదివాసి సమస్యగా చూడాలనే ఆలోచన ఎవ్వరికీ లేదు. 

ఇటు భారత దేశంలో అయినా అటు పాకిస్తాన్ లో అయినా చాలా కాలం ప్రజావ్యతిరేక ప్రభుత్వాలే పాలన సాగించాయి. రెండు దేశాల్లోని ప్రభుత్వాలు  ప్రజామోదాన్ని కోల్పోయినప్పుడెల్లా దేశభక్తి పేరునో మతం పేరునో  భావోద్వేగాలను రెచ్చగొట్టి, ఓట్ల సమీకరణకు ఉపయోగించుకుని రాజకీయంగా లబ్ది పొందడానికి  అందుబాటులో వుండేలా కాశ్మీర్  కుంపటిని  నిరంతరం మండిస్తూ వచ్చాయి.

సంఘపరివారం అయోధ్యలో బాబ్రీ మసీదును కూల్చి రామమందిరాన్ని నిర్మిస్తామని శపథం చేసినపుడు కూడ కశ్మీర్ లోయలో కదలిక రాలేదు. కామన్ సివిల్ కొడ్ ను రూపొందిస్తాము అన్నప్పుడూ కశ్మీరీల ఇస్లాం ధార్మిక అస్తిత్వం పెద్దగా స్పందించలేదు. రాజ్యాంగంలోని 370వ అధీకరణాన్ని రద్దుచేసి కశ్మీర్ ను ఇండియాలో సంపూర్ణంగా విలీనం చేస్తామన్న తరువాత కశ్మీర్ లోయ తీవ్రంగా స్పందించింది. అది తీవ్రవాదం పుట్టుకకు నాందీ పలికింది.

తీవ్రవాదం పుట్టుకకు సమర్ధన వుండవచ్చుగానీ దాని కార్యకలాపాలకు ఎలాంటి సమర్ధనా వుండదు. తీవ్రవాదం తరచూ తాను ప్రకటించుకున్న లక్ష్యాలకు పూర్తి వ్యతిరేకంగా వ్యవహరించి తనను తానే అంతం చేసుకుంటుంది.

1948 ఆరంభంలోనే భారతదేశం కాశ్మీర్ సమస్యను ఐక్యరాజ్య సమితి దృష్టికి తీసుకుని వెళ్ళింది.  మత అస్తిత్వం  చురుగ్గా వున్నప్పుడు వున్నప్పుడు పశ్చిమ, తూప్రు పాకిస్తాన్ లు ఏకమయ్యాయి. జాతి, భాష, ప్రాంత అస్తిత్వాలు చురుగ్గా మారినపుడు తూర్పు పాకిస్తాన్ విడిపోయి బంగ్లాదేశ్ ఏర్పడింది.   ముస్లింలకు మతం ఒక్కటే అస్తిత్వం కాదని 1971 నాటి బంగ్లాదేశ్ యుధ్ధం గొప్పగా నిరూపించింది. ఆ తరువాత 1972లో జరిగిన సిమ్లా ఒప్పందం మేరకు నియంత్రణ రేఖ (LOC) అమల్లోనికి వచ్చింది.

నియంత్రణ రేఖకు అటూ ఇటూ కూడా కశ్మీర్ లోయ వుంది.  కశ్మీర్ లోయలో ఇప్పుడు జాతీయ తిరుగుబాటుదార్లు వున్నారు, పాకిస్తాన్ చొరబాటుదార్లు వున్నారు. తిరుగుబాటుదార్లను, చొరబాటుదార్లను మీడియా అజ్ఞానంతో ఒకేగాటన కడుతుంటుంది. 

అలాగే కశ్మీర్ సరిహద్దుల్లో పాకిస్తాన్ ను నిలవరించడానికి భారత సైన్యం వుంటుంది, రాష్ట్రంలో అనేక చోట్ల ఆందోళనకారుల్ని అదుపుచేయడానికి సిఆర్ పిఎఫ్ క్యాంపులు వుంటాయి. మొదటిది; రక్షణశాఖ ఆధీనంలో వుంటే రెండోది కేంద్ర హోంశాఖ ఆధీనంలో వుంటుంది. కేంద్ర భద్రతా దళలను కొందరు  పోలీసులుగా కాకుండ సైన్యం అనుకుంటారు. ఇదొక అజ్ఞానపు గందరగోళం. సిఆర్ పిఎఫ్ లో పి అంటే పోలీస్ అని చాలామంది మరిచిపోతుంటారు.  

సరిహద్దులో యుధ్ధ వాతావరణం వుంటే కేంద్రంలోని అధికారపార్టిలకు రాజకీయ లబ్ది చేకూరుతుంది. సైనికాధికారులకు ఆర్ధిక లబ్ది కూడ  చేకూరుతుంది. పాకిస్తాన్ రక్షణ వ్యయం సాలీన 70 వేల కోట్ల రూపాయలు. భారత రక్షణ వ్యయం సాలీన 3 లక్షల కోట్ల రూపాయలు. ఈ స్థాయిల్లో రెండు దేశాలు రక్షణ వ్యయాన్ని పెంచుకుంటూ పోతున్నాయి. ఇరుదేశాల రక్షణ విభాగాలకు ఇంకో సౌలభ్యం కూడ వుంది. కేటాయించిన నిధుల ఖర్చును అవి బహిరంగంగా లెఖ్ఖలు చెప్పాల్సిన పనిలేదు. రక్షణ రహాస్యాల పరిరక్షణ చట్టాన్ని అడ్డుపెట్టుకుని తాము లెఖ్ఖలు చెప్పేది లేదు అని రక్షణ విభాగం అంటే సుప్రీం కోర్టు కూడ చేయగలిగిందేమీ లేదు. 

కశ్మీర్ వల్ల ఇన్ని శక్తులకు ఇన్ని ప్రయోజనాలు వుండవచ్చుకానీ, నిరంతరం మండుతూ వుండడం కశ్మీరీలకు ఎంత కష్టం?

A.        Instrument of Accession

1.           Instrument of Accession (Jammu and Kashmir)

2.           In a letter sent to Maharaja Hari Singh on 27 October 1947, the then Governor-General of India, Lord Mountbatten of Burma accepted the accession with a remark, "it is my Government's wish that as soon as law and order have been restored in Jammu and Kashmir and her soil cleared of the invader the question of the State's accession should be settled by a reference to the people."

3.           Lord Mountbatten's remark and the offer made by the Government of India to conduct a plebiscite or referendum to determine the future status of Kashmir led to a dispute between India and Pakistan regarding the legality of the accession of Jammu and Kashmir to India. India claims that the accession is unconditional and final while Pakistan maintains that the accession is fraudulent.

4.           Both, India and Pakistan had their own interpretation of this Truce Agreement, like disbanding the Azad Kashmir Force, etc and hence, plebiscite was never held.

5.           On 17 October 1949, Indian Constituent Assembly adopted Article 370 of the Constitution ensuring special status and internal autonomy to Jammu and Kashmir.

6.           Article 370 of the Indian constitution is an article that gives autonomous status to the state of Jammu and Kashmir. The article is drafted in Part XXI of the Constitution: Temporary, Transitional and Special Provisions.

7.           Since Article 370 was enacted on 26 November 1949 as part of the Constitution of India by the Constituent Assembly of India which was a sovereign body, he remarks, Article 35A "flows inexorably" from it. ... Article 35 A protects the demographic status of the Jammu and Kashmir state in its prescribed constitutional form.

8.           Article 370 was worked out in late 1947 between Sheikh Abdullah, who had by then been appointed Prime Minister of J&K by the Maharaja and Nehru, who kept the Kashmir portfolio with himself and kept Sardar Patel, the home minister, away from his legitimate function

9.           The state of Jammu and Kashmir's original accession, like all other princely states, was on three matters: defence, foreign affairs and communications.

10.        All the princely states were invited to send representatives to India's Constituent Assembly, which was formulating a constitution for the whole of India. They were also encouraged to set up constituent assemblies for their own states. Most states were unable to set up assemblies in time, but a few states did, in particular Saurashtra Union, Travancore-Cochin and Mysore.

11.        Even though the States Department developed a model constitution for the states, in May 1949, the rulers and chief ministers of all the states met and agreed that separate constitutions for the states were not necessary.

12.        They accepted the Constitution of India as their own constitution. The states that did elect constituent assemblies suggested a few amendments which were accepted. The position of all the states (or unions of states) thus became equivalent to that of regular Indian provinces. In particular, this meant that the subjects available for legislation by the central and state governments was uniform across India.

13.        In the case of Jammu and Kashmir, the representatives to the Constituent Assembly requested that only those provisions of the Indian Constitution that corresponded to the original Instrument of Accession should be applied to the State.

14.        Accordingly, the Article 370 was incorporated into the Indian Constitution, which stipulated that the other articles of the Constitution that gave powers to the Central Government would be applied to Jammu and Kashmir only with the concurrence of the State's constituent assembly.

15.        This was a "temporary provision" in that its applicability was intended to last till the formulation and adoption of the State's constitution. However, the State's constituent assembly dissolved itself on 25 January 1957 without recommending either abrogation or amendment of the Article 370.

C.          High Court and Supreme Court
16.        In October 2015, the High Court of Jammu and Kashmir has ruled that the Article 370 cannot be "abrogated, repealed or even amended." It explained that the clause (3) of the Article conferred power to the State's Constituent Assembly to recommend to the President on the matter of the repeal of the Article.

17.        Thus the Article has become a permanent feature of the Indian constitution, as confirmed by various rulings of the Supreme Court of India and the High Court of Jammu and Kashmir, the latest of which was in April 2018.

18.        Simla Agreement on Bilateral Relations between India and Pakistan signed by Prime Minister Indira Gandhi, and President of Pakistan, Z. A. Bhutto, in Simla on 2 July 1972.

19.        In Jammu and Kashmir, the line of control resulting from the ceasefire of December 17, 1971, shall be respected by both sides without prejudice to the recognized position of either side. Neither side shall seek to alter it unilaterally, irrespective of mutual differences and legal interpretations. Both sides further undertake to refrain from the threat or the use of force in violation of this line.

28.        Right-wing Bharatiya Janata Party (BJP) under the leadership of Atal Bihari Vajpayee incorporated Gandhian socialism as one of the concepts for the party.

30.        Operation Blue Star was the codename of an Indian military action carried out between 1 and 8 June 1984 to remove militant religious leader Jarnail Singh Bhindranwale and his followers from the buildings of the Harmandir Sahib (Golden Temple) complex in Amritsar, Punjab.

31.        In September 1984, the VHP followed up its Dharam Sansad with a bike rally that ended at the banks of the Sarayu river in Ayodhya. VHP activists pledged to rebuild a Ram Mandir by mobilising Hindus from across the country. The kar sevaks were to lay the foundation for a Mandir on 31 October 1984.

55.        July and August 1989 – 3 CRPF personnel and politician Mohd. Yusuf Halwai of NC/F were killed.

56.        1989 kidnapping of Rubaiya Sayeed daughter of the then Home Minister of India Mufti Sayeed.

57.        1995 kidnapping of western tourists in Jammu and Kashmir – Six foreign trekkers from Anantnag district were kidnapped by Al Faran. One was beheaded later, one escaped, and the other four remain missing, presumably killed.

58.        1997 Sangrampora massacre – On 22 March 1997, seven Kashmiri Pandits were killed in Sangrampora village in the Budgam district.

59.        Wandhama massacre – In January 1998, 24 Kashmiri Pandits living in the village of Wandhama were massacred by Pakistani militants. According to the testimony of one of the survivors, the militants dressed themselves as officers of the Indian Army, entered their houses and then started firing blindly. The incident was significant because it coincided with former US president Bill Clinton's visit to India and New Delhi highlighted the massacre to prove Pakistan-supported terrorism in Kashmir .

60.        1998 Prankote massacre – 26 Hindu villagers of Udhampur district were killed by militants.

61.        1998 Champanari massacre – 25 Hindu villagers killed on 19 June 1998 by Islamic militants.

62.        2000 Amarnath pilgrimage massacre – 30 Hindu pilgrims massacred by militants.

63.        Chittisinghpura massacre – 36 Sikhs massacred by LET militants.

64.        2001 terrorist attack on Jammu and Kashmir legislative assembly – On 1 October 2001, a bombing at the Legislative Assembly in Srinagar killed 38.

65.        2002 Raghunath temple attacks – First attack occurred on 30 March 2002 when two suicide bombers attacked the temple. Eleven persons including three security forces personnel were killed and 20 were injured. In second attack, the fidayeen suicide squad attacked the temple second time on 24 November 2002 when two suicide bombers stormed the temple and killed fourteen devotees and injured 45 others.

66.        2002 Qasim Nagar massacre – On 13 July 2002, armed militants believed to be a part of the Lashkar-e-Toiba threw hand grenades at the Qasim Nagar market in Srinagar and then fired on civilians standing nearby killing 27 and injuring many more.

67.        2003 Nadimarg Massacre – 24 Hindus killed in Nadimarg, Kashmir on 23 March 2003 by Lashkar-e-Taiba militants.

68.        20 July 2005 Srinagar Bombing – A car bomb exploded near an armoured Indian Army vehicle in the famous Church Lane area in Srinagar killing 4 Indian Army personnel, one civilian and the suicide bomber. Militant group Hizbul Mujahideen, claimed responsibility for the attack.

69.        Budshah Chowk attack – A militant attack on 29 July 2005 at Srinigar's city centre, Budshah Chowk, killed 2 and left more than 17 people injured. Most of those injured were media journalists.

70.        Assassination of Ghulam Nabi Lone – On 18 October 2005, suspected Kashmiri militants killed Jammu and Kashmir's then education minister Ghulam Nabi Lone. Militant group called Al Mansurin claimed responsibility for the attack. Abdul Ghani Lone, a prominent All Party Hurriyat Conference leader, was assassinated by unidentified gunmen during a memorial rally in Srinagar. The assassination resulted in wide-scale demonstrations against the Indian forces for failing to provide enough security cover for Lone.

71.        2006 Doda massacre – On 3 May 2006, militants massacred 35 Hindus in Doda and Udhampur districts in Jammu and Kashmir.

72.        On 12 June 2006, one person was killed and 31 were wounded when terrorists hurled three grenades on Vaishnodevi shrine-bound buses at the general bus stand.

73.        2014 Kashmir Valley attacks – There were four attacks on 5 December 2014 on army, police and civilians resulted in 21 deaths and several injured. Their motive was to disrupt the ongoing assembly elections.

74.        2016 Uri attack – Four armed terrorists sneaked into an army camp and lobbed grenades onto tents causing massive fire culminating in the death of 19 military personnel.

75.        2018 Sunjuwan attack - On 10 February 2018, Jaish-e-Mohammad terrorists attacked Sunjuwan Army Camp in Jammu and Kashmir. 6 Indian army soldiers, 4 terrorists, 1 civilian died and 11 were injured.

76.        2019 Pulwama attack - On 14 February 2019, Jaish-e-Mohammad terrorists attacked a convoy of CRPF men killing 46 soldiers and injuring 20.

93.        భారత దేశంలో ఉదారవాద హిందూ సమాజాన్ని సంఘపరివారం ఛాందస మత సమూహంగా మార్చే ప్రయత్నాలు మొదలెట్టిన తరువాత కశ్మీర్ లోనూ ధార్మిక రంగంలో మార్పులు వచ్చాయి.

94.        మొదట్లో తిరుగుబాట్లకు వేదికగా నిలిచిన జమ్ము-కశ్మీర్ లిబరేషన్ ఫ్రంట్ (JKLF) కశ్మీరియత్ ను తన ప్రాపంచిన దృక్పథంగా ప్రకటించుకుంది.

95.        ఆ తరువాతి కాలంలో సాంప్రదాయిన ఇస్లామిక్ ప్రాపంచిక దృక్పథం కలిగిన హిజ్ బుల్ ముజాహిదీన్ ప్రాబల్యం పెరిగింది. దానికి క్యాడర్ సంఖ్య పెరగడంతో ప్రధాన గ్రూపుగా ఎదిగింది.

96.        హిజ్ బుల్ ముజాహిదీన్ ద్వ్విజాతి సిధ్ధాంతాన్ని ప్రచారం చేస్తుంది.

97.        బాహ్యాత్మక కారణాలవల్ల హిజ్ బుల్ ముజాహిదీన్ లో చేరినప్పటికీ చాలా మంది కశ్మీరీలు  కశ్మీరియత్ నే ఎక్కువగా ప్రేమిస్తారు. ఈ కారణం వల్లనే పండిట్ లు ముస్లింల మధ్య పాత బంధాల పునరుధ్ధరణ సాగుతోంది. 

98.        కశ్మీర్ లో దర్గాల్లో ప్రార్ధనలు జరిపే ముస్లింలకూ, అక్కడ ప్రార్ధనలు జరపడం ఇస్లాం సాంప్రదాయానికి వ్యతిరేకం అనే ముస్లింలు వుంటారు.

99.        దర్గాల్లో ప్రార్ధనలు జరపడం ఇస్లాం సాంప్రదాయానికి వ్యతిరేకం అనే ముస్లింల కన్నా దర్గాల్లో ప్రార్ధనలు జరిపే ముస్లింల ప్రాబల్యమే ఎక్కువ.

100.     హిజ్ బుల్ ముజాహిదీన్ నాయకులైన సయ్యద్ ఆలీషా గిలానీ వంటువారు సహితం ఒక మెట్టుదిగి దర్గాలకు వెళ్ళి ఉపన్యాసాలు ఇస్తుంటారు.

101.     వీటిల్లో శ్రీనగర్ లోని హజ్రత్ బల్ దర్గా ప్రముఖమైనది.

102.     కశ్మీర్ లో  హిజ్ బుల్ ముజాహిదీన్ వంటి  ఇస్లాం మతవాదుల ప్రభావం 20 శాతం వుంటే, సెక్యూలర్ కశ్మీరీ జాతీయవాదుల ప్రభావం 80 శాతం వుంటుంది.

103.     జమాతే ఇస్లామీ వంటి సాంప్రదాయ ఇస్లాం సంస్థల ప్రభావం పెద్ద తరం మీడ వున్నప్పటికి కాశ్మీరీ యువతరం  ఛాందసవాదుల మీద ఆసక్తిని చూపడంలేదు.

104.     కానీ బయటి ప్రపంచానికి సెక్యూలర్ కశ్మీరీ జాతీయవాదుల కన్నా ఇస్లాం మతవాదుల ప్రభావం ఎక్కువగా వున్నట్టు కనిపిస్తుంది.

105.     దీనికి రెండు కారణాలున్నాయి.

106.     మొదటి కారణం, హిజ్ బుల్ ముజాహిదీన్ క్యాడర్ దగ్గర తుపాకులుంటాయి.

107.     రెండవ కారణం, భారత ప్రభుత్వం కశ్మీరి పోరాటకారులుగా సెక్యూలర్ కశ్మీరీ జాతీయవాదుల్ను చూపదు.

108.     ఇస్లాం మతవాదుల్ని మాత్రమే కశ్మీరి పోరాటకారులుగా ఫోకస్ చేస్తుంది.

109.     కశ్మీర్ లోయలో కశ్మీరీ జాతీయవాదులతో పోరాటం చేయడంలేదనీ ద్విజాతి సిధ్ధాంతాన్ని ప్రచారం చేస్తున్న ఇస్లాం మతవాదుల్ని మాత్రమే పోరాటం చేస్తున్నట్టు చెప్పుకోవడం భారత ప్రభుత్వానికి అవసరం.

110.     భారత స్వతంత్ర చట్టం 1947 ప్రకారం కశ్మీరీలకు మూడు ఆప్షన్లున్నాయి.  ఎదో ఒకదాన్ని ఎంచుకోవడం వారి స్వయం నిర్ణయాధికార హక్కు.

113.     1920వ దశకంలో కాశ్మీర్ పరిపాలనా యంత్రాంగం అంతా డోగ్రా రాజ్ పుట్ ల చేతుల్లో వుండేది.

114.     పండిట్లు గ్రామాలో వ్యవసాయం చేసేవారు. పట్టణాల్లో వైట్ కాలర్ ఉద్యోగాలు చేసేవారు.

115.     కార్యనిర్వాహకవర్గంలో  రాజ్ పుట్ ల ప్రాబల్యం ఎక్కువగా వుండడంవల్ల పండిట్లూ అసంతృప్తితో వుండేవారు.

116.     ముస్లింలలో కొందరు జాగీర్దార్లను మినహాయిస్తే మిగిలినవాళ్లంతా కటిక పేదరికంలో గడిపేవారు.

117.     మహారాజ హరిసింగ్ రాజకీయ సలహాదారు సర్ అల్బియన్ బెనర్జీ మాటల్లో చెప్పాలంటే అప్పటి కాశ్మీర్ ముస్లింలు “నిరక్షరాశ్యులు, పేదలు, కూలీలు,  నోరు లేని పశువులు”

118.     అలిగడ్ ముస్లిం యూనివర్శిటీ నుండి  రసాయన శాస్త్రంలో పోస్ట్ గ్రాడ్యూయేట్ అయిన షేక్ అబ్దుల్లా 1924లో టీచర్  ఉద్యోగాన్ని వదిలి కాశ్మీర్ విముక్తి బాధ్యతను చేపట్టాడు.

119.     సోషలిస్టు భావాలున్న అబ్దుల్లా ముస్లింల మీద వివక్షను తొలగించాలని మహారాజుకు తరచూ అర్జీలు పెడుతుండేవాడు. సభలు సమావేశాల్లో కాశ్మీర్ ప్రజల సమస్యల మీద ఆవేశంగా మాట్లాడేవాడు.

120.     ముస్లిం సమస్యల్ని వివరించడానికి షేక్ అబ్దుల్లాతో సహా ఏడుగురు ప్రతినిధుల్ని కలవడానికి 1931లో మహారాజు హరిసింగ్ అనుమతి ఇచ్చాడు. 

121.     మహారాజు ముందు ఏఏ అంశాలను ప్రస్తావించి పరిష్కారం కోరాలనే విషయం మీద అనేక సభలు నిర్వహించారు.

122.     అబ్దుల్ ఖదీర్ ఖాన్ ఘాజీ అనే యువకుడు 1931 జూన్ 21న ఒక బహిరంగ సభలో ఆవేశంతో ఉపన్యాసం ఇచ్చాడు.

123.     అబ్దుల్ ఖదీర్ ఉపన్యాసాన్ని మహరాజు అధికారులు రాజద్రోహంగా భావించారు. అతని మీద కేసు పెట్టి అరెస్టు చేశారు.

124.     జులై 6న అబ్దుల్ ఖదీర్  కేసు మీద గవర్నర్ విచారణ ప్రారంభం కావడానికి ముందే శ్రీనగర్ వాసులు న్యాయస్థానామ్మొ చుట్టుముట్టారు.

125.     దానితో న్యాయస్థానాన్ని శ్రీనగర్ సెంట్రల్ జైలు ఆవరణకు తరలించారు.

126.     మలి విడత విచారణ జరగనున్న జులై 13న  శ్రీనగర్ సెంట్రల్ జైలును జనం  చుట్టుముట్టారు.

127.     పోలీసు బలగాలతో అక్కడికి చేరుకున్న తుర్లోక్ చంద్ గవర్నర్ మీద జనం రాళ్ళు రువ్వారు. గవర్నర్ ఆవేశంతో పోలీసు కాల్పులకు ఆదేశాలిచ్చాడు.

128.     పోలీసు కాల్పుల్లో 22 మంది చనిపోయారు. ఒకతను చనిపోతూ  షేక్ అబ్దుల్లాను గట్టిగా పట్టుకుని  "I have done my duty and now you proceed ahead!" అన్నాడట.

129.     ఈ ఘటనను షేక్ అబ్దుల్లా  మరో జలియన్ వాలా బాగ్  అనేవారు.

130.     శ్రీనగర్ వీధుల్లో  మృత వీరుల శవాలతో  భారీ యాత్ర జరిగింది. తరువాత వాళ్ళందర్ని Kanqah-i-Maula శ్మశానవాటికలో ఖననం చేశారు.  అప్పటి నుండీ ఆ శ్మశానాన్ని కాశ్మీరీలు "Mazar-i-Shuhada" అంటారు.

131.     ప్రపంచ వ్యాప్తంగా కాశ్మీరీలు జులై 13ను అమరవీరుల దినంగా పాటిస్తారు. LOC కి తూర్పు దిక్కున వున్నవారు సహితం ఆ రోజు మృతవీరులకు నివాళులు అర్పిస్తారు.

132.     పోలీసులు మీద రాళ్ళు రువ్వడం, శవయాత్రను ఒక నిరసన ప్రదర్శనగా మార్చడం అనే సాంప్రదాయం అప్పటి నుండే వచ్చింది.

133.     కశ్మీరీల పోరాటంలో భూస్వామ్య వ్యతిరేకత వుంది. రాచరిక పాలన మీద నిరసన వుంది. ముస్లిం సమూహాల మీద సాగుతున్న వివక్షను తొలగించాలనే లక్ష్యం వుంది. విదేశీ పాలన నుండి విముక్తి చెందాలనే ఆకాంక్ష వుంది. ఈ నాలుగు అంశాల్లో  దేన్ని మినహాయించినా కాశ్మీరీల జాతీయవాద పోరాటం అర్ధం కాదు.

134.     షేక్ అబ్దుల్లా ముస్లిం, ఇస్లామీయ సాంప్రదాయాలను ఆచరించే వ్యక్తి. కొన్నిసార్లు మసీదుల్లోనూ సమావేశాలు జరిపి ప్రసంగించేవాడు. అయినప్పటికీ తన పోరాటాన్ని ముస్లింలకే పరిమితఅం చేయడానికి ఒప్పుకునేవాడుకాదు.

135.     కశ్మీరీ పండిట్లు కశ్మీరీ పండిట్ల కాన్ఫెరెన్స్ ను నెలకొల్పినపుడు హిందూ ముస్లింల మధ్ర కొంత విద్వేషాలు పొడచూపాయి.

136.     జమ్ము కశ్మీర్ ముస్లిం కాన్ఫరెన్స్ సహనంతో చాకచక్యంతో  విద్వేషాన్ని చల్లార్చివేసింది.

137.     కాశీర్ లోయలో ఎప్పుడూ మతఘర్షణలు లేవు.

138.     జమ్ము కశ్మీర్ ముస్లిం కాన్ఫరెన్స్ లో రెండు పథాల పోరాటం ఎప్పుడూ వుండేది. ఒకవర్గం సనాతన ముస్లిం సాంప్రదాయంలో నడపాలని వాదించేది. ఇంకోవర్గం సామాజిక సమానత్వ దృక్పథంతో సాగాలనేది.

139.      షేక్ అబ్దుల్లా  సామాజిక సమానత్వ దృక్పధాన్ని ఎంచుకున్నాడు. “హిందూ, ముస్లిం, శిక్కులు కలిసి బ్రతకడం నేర్చుకోకపోతే ఏ ప్రగతీ సాధ్యంకాదు” అనేవాడు.

140.     జమ్ము కశ్మీర్ ముస్లిం కాన్ఫరెన్స్  వ్యవస్థాపకుల్లో ఒకడైన మీర్ వైజ్ యూసుఫ్ షా సనాతన ముస్లిం వాది. అబ్దుల్లా పంథాతో విభేదించేవాడు. చివరకు విడిపోయి ఆజాద్ ముస్లిం కాన్ఫరెన్స్ ను ఏర్పాటు చేసుకున్నాడు. 

141.     కేడర్, నాయకుల్లో అట్యధికులు షేక్ అబ్దుల్లాతోనే వుండిపోయారు.  

142.     ఆజాద్ ముస్లిం కాన్ఫరెన్స్  నాయకులైన బక్షి గులాం అహమ్మద్, గులాం సాదిక్ లు తరువాతి కాలంలో భారత ప్రభుత్వం చేతుల్లో పనిముట్లుగా మారారు.

143.     జమ్ము కశ్మీర్ ముస్లిం కాన్ఫరెన్స్  డిమాండ్లకు తలొగ్గి మహరాజ ఒక రకం చట్ట సభను ఏర్ప్సాటు చేశాడు. అప్పుడు జరిపిన ఎన్నికల్లో జమ్ము కశ్మీర్ ముస్లిం కాన్ఫరెన్స్   గెలిచింది.

144.     సోషలిస్టు అయిన షేక్ అబ్దుల్లాకు   జవహర్ లాల్ నెహ్రు, అల్లమా ఇక్బాల్ లతో సన్నిహిత సంబంధాలు ఏర్పడ్డాయి.

145.     జమ్ము కశ్మీర్ ముస్లిం కాన్ఫరెన్స్  పేరులో ముస్లిం పదాన్ని తీసేసి ఆ మేరకు సంస్థ మేనిఫెస్టోను  సవరించాలని  నెహ్రు, ఇక్బాల్ కోరారు.

146.     దానికి అంగీకరించిన  షేక్ అబ్దుల్లా జమ్ము కశ్మీర్ ముస్లిం కాన్ఫరెన్స్  ను  నేషనల్ కాన్ఫరెన్స్ గా మార్చాడు.  అధ్యక్షునిగా సర్దార్ బుధ్ సింగ్ ను ఎన్నుకున్నారు. 

147.     అప్పటి భావోద్వేగాల్లో మతేతర సంస్థను నడపడం అంత సులువుకాదు. హిందూ, ముస్లిం సమాజాల్లోని ఛాందసులు అనేక ఇబ్బందులు పెట్టారు.

148.     నేషనల్ కాన్ఫరెన్స్ నేషనల్ కాంగ్రెస్ తో సన్నిహిత సంబంధాలను కొనసాగించింది.

149.     ముస్లిం లీగ్ ను శేక్ అబ్దుల్లా వ్యతిరేకించేవారు. దాన్ని నవాబుల పార్టి అనేవారు.

150.     స్త్రీలు, కార్మికులు, బలహీనవర్గాల హక్కుల్ని పరిరక్షించాలని 1944 నాటి బారాముల్లా మహాసభలో నేషనల్ కాన్ఫరెన్స్ తీర్మానించింది.  హిందూ ముస్లిం సమాజాల్లోని ఛాందసులు ఈ తీర్మానాన్ని వ్యతిరేకించారు. అయినా షేక్ అబ్దుల్లా వెనుకాడలేదు.

151.     1947 తరువాత కాశ్మిర్ లో ఏర్పడిన అజార్ కాశ్మీర్  ప్రాంతంలో తొలి ప్రభుత్వాన్ని ఏర్పాటు చేసింది ఆజాద్ ముస్లిం కాన్ఫరెన్స్.

152.     On August 7, 1990, then PM V P Singh announced in Parliament that his government had accepted the Mandal Commission report, which recommended 27% reservation for OBC candidates at all levels of its services.

154.     NEW DELHI: The Supreme Court is likely to hear a batch of pleas challenging the constitutional validity of Article 35A, which provides special rights and privileges to natives of the state of Jammu and Kashmir, this week. The crucial hearing, which could be listed from February 26 to February 28, assumes significance in view of the political discourse over the issue.

155.     The petitions were last listed for hearing by a regular bench on February 19, 20 and 21, but adjourned for lack of time. It is before a bench led by Chief Justice of India Ranjan Gogoi and Justices L Nageswar Rao and Sanjiv Khanna.

156.     As per the regular list, the case can come up any time now, but a quick hearing is unlikely, given the sensitivities involved in the case. CJI Ranjan Gogoi’s refusal to heed to the plea of J&K counsel Shoeb Alam, at the last hearing, that the issue be deferred till an elected government was in place has given the impression that the case will come up for hearing sooner.

157.     Rejecting Alam’s plea the CJI had said that the case cannot be kept pending. “There is always some government in place. There can be no vacuum,” the CJI had remarked.

158.     The state is under president’s rule where the Union Cabinet takes calls on every administrative decision through the governor. The state’s counsel had sought adjournments on the ground that local polls were underway and that the ground situation was sensitive when the PDP-BJP government was in power.

159.     There is no indication of the Centre’s formal stand on the issue, though there has been a clamour among a section of public to do away with Articles 370 and 35A to bring J&K on par with the rest of India.

160.     As per the provisions, non-residents cannot buy property in J&K or get other facilities such as jobs and admissions in local institutions. Even Kashmiri women who marry residents of other states lose the right. Their children lose inheritance rights too.

161.     What is Article 35A? Article 35A of the Indian Constitution is an article that empowers the Jammu and Kashmir state's legislature to define “permanent resident” of the state and provide special rights and privileges to those permanent residents which are excluded for non-permanent residents.

162.     It was added to the Constitution through a Presidential Order, i.e., The Constitution (Application to Jammu and Kashmir) Order, 1954 – issued by the President of India on 14 May 1954, exercising the powers conferred by the clause (1) of the Article 370 of the Indian Constitution, and with the concurrence of the Government of the State of Jammu and Kashmir.

163.     The Article 35A was incorporated in the Constitution in 1954 through a presidential order on recommendations of the then PM Jawahar Lal Nehru’s cabinet. This provision gives J&K legislature right to decide who are permanent residents of the state and ensure their special rights and privileges in government jobs, scholarships, aids and acquisition of property.

164.     No non-state subject can buy land or settle permanently in J&K. The spirit of the article flows from 1927 and 1932 state subject laws of then Dogra ruler.

165.     Prior to 1947, Jammu and Kashmir was a princely state under the British Paramountcy. The people of the princely states were "state subjects", not British colonial subjects.

166.     In the case of Jammu and Kashmir, the political movements in the state in the early 20th century led to the emergence of "hereditary state subject" as a political identity for the State's people.

167.     In particular, the Pandit community had launched a "Kashmir for the Kashmiri" movement demanding that only Kashmiris should be employed in state government jobs.

168.     Legal provisions for the recognition of the status were enacted by the Maharaja of Jammu and Kashmir between 1912 and 1932. The 1927 Hereditary State Subject Order granted to the state subjects the right to government office and the right to land use and ownership, which were not available to non-state subjects.

169.     Discussions for furthering the relationship between the State and the Union continued, culminating in the 1952 Delhi Agreement, whereby the governments of the State and the Union agreed that Indian citizenship would be extended to all the residents of the state but the state would be empowered to legislate over the rights and privileges of the state subjects, who would now be called permanent residents.

171.     The Kashmir dispute dates from 1947. The partition of the Indian sub-continent along religious lines led to the formation of India and Pakistan. However, there remained the problem of over 650 states, run by princes, existing within the two newly independent countries.

172.     In theory, these princely states had the option of deciding which country to join, or of remaining independent. In practice, the restive population of each province proved decisive.

173.     The people had been fighting for freedom from British rule, and with their struggle about to bear fruit they were not willing to let the princes fill the vacuum.

174.     Although many princes wanted to be "independent" (which would have meant hereditary monarchies and no hope for democracy) they had to succumb to their people's protests which turned violent in many provinces.

175.     Because of its location, Kashmir could choose to join either India or Pakistan. Maharaja Hari Singh, the ruler of Kashmir, was Hindu while most of his subjects were Muslim. Unable to decide which nation Kashmir should join, Hari Singh chose to remain neutral.

176.     But his hopes of remaining independent were dashed in October 1947, as Pakistan sent in Muslim tribesmen who were knocking at the gates of the capital Srinagar.

177.     Hari Singh appealed to the Indian government for military assistance and fled to India. He signed the Instrument of Accession, ceding Kashmir to India on October 26.

178.     Indian and Pakistani forces thus fought their first war over Kashmir in 1947-48. India referred the dispute to the United Nations on 1 January. In a resolution dated August 13, 1948, the UN asked Pakistan to remove its troops, after which India was also to withdraw the bulk of its forces.

179.     Once this happened, a "free and fair" plebiscite was to be held to allow the Kashmiri people to decide their future.

180.     India, having taken the issue to the UN, was confident of winning a plebiscite, since the most influential Kashmiri mass leader, Sheikh Abdullah, was firmly on its side. An emergency government was formed on October 30, 1948 with Sheikh Abdullah as the Prime Minister.

181.     Pakistan ignored the UN mandate and continued fighting, holding on to the portion of Kashmir under its control. On January 1, 1949, a ceasefire was agreed, with 65 per cent of the territory under Indian control and the remainder with Pakistan.

182.     The ceasefire was intended to be temporary but the Line of Control remains the de facto border between the two countries.

183.     In 1957, Kashmir was formally incorporated into the Indian Union. It was granted a special status under Article 370 of India's constitution, which ensures, among other things, that non-Kashmiri Indians cannot buy property there.

184.     Fighting broke out again in 1965, but a ceasefire was established that September. Indian Prime Minister, Lal Bhadur Shastri, and Pakistani President, M Ayub Khan, signed the Tashkent agreement on January 1, 1966.

185.     They resolved to try to end the dispute, but the death of Mr Shastri and the rise of Gen Yahya Khan in Pakistan resulted in stalemate.

186.     In 1971a third war, resulting in the formation of the independent nation of Bangladesh (formerly known as East Pakistan). A war had broken out in East Pakistan in March 1971, and soon India was faced with a million refugees.

187.     India declared war on December 3, 1971 after Pakistani Air Force planes struck Indian airfields in the Western sector.

188.     Two weeks later, the Indian army marched into Dhaka and the Pakistanis surrendered. In the Western sector the Indians managed to blockade the port city of Karachi and were 50 km into Pakistani territory when a ceasefire was reached.

189.     In 1972 Indira Gandhi, the Indian prime minister, and Zulfikar Ali Bhutto, her Pakistani opposite number (and father of Benazir Bhutto, a later Pakistani premier), signed the Simla Agreement, which reiterated the promises made in Tashkent.

190.     The two sides once again agreed to resolve the issue peacefully, as domestic issues dominated.

191.     Both India and Pakistan had other important domestic problems which kept Kashmir on the back-burner. In 1975 Indira Gandhi declared a state of national emergency, but she was defeated in the 1978 general elections.

192.     Zulfikar Ali Bhutto was overthrown and hanged in 1977; Pakistan reverted to military dictatorship under Gen Zia ul Haq.

193.     The balance of influence had decisively tilted in Pakistan's favour by the late 1980s, with people's sympathy no longer with the Indian union as it had been in 1947-48 and 1965.

194.     Mrs Gandhi's attempts to install puppet governments in state capitals, manipulating the democratic process in the state legislatures, deeply angered the Kashmiris.

195.     The status quo was largely maintained until 1989 when pro-independence and pro-Pakistan guerrillas struck in the Indian Kashmir valley. They established a reign of terror and drove out almost all the Hindus from the valley before the Indian army moved in to flush them out. Meanwhile Indian and Pakistani troops regularly exchanged fire at the border.

196.     Whereas in 1948 India took the Kashmir issue to the UN and was all for a plebiscite, by the 1990s it hid behind the Simla agreement and thwarted any attempts at UN or third-party mediation.

197.     Over the decades the plebiscite advocated by India's great statesman Jawaharlal Nehru became a dirty word in New Delhi. These developments have led many to believe that Delhi has squandered the Kashmiri people's trust and allegiance.

198.     India and Pakistan both tested nuclear devices in May 1998, and then in April 1999 test-fired missiles in efforts to perfect delivery systems for their nuclear weapons. Pakistan tested its Ghauri II missile four days after India's testing of its long-range (1,250 km) Agni II.

199.     Although Pakistan claims that its missiles are an indigenous effort, in July 1999 Indian customs agents seized components shipped from North Korea which they claim were destined for Pakistan's missile programme.

200.     Pakistan's later intermediate-range Ghauri III missile has a range of about 3,000 km.

201.     When the Indian Prime Minister, Atal Behari Vajpayee, set out to Lahore by bus on February 20, 1999, inaugurating the four times a week Delhi-Lahore-Delhi bus service, the world felt that such a genuine effort at friendly neighbourhood relations would lower the tension along the Line of Control in Kashmir.

202.     But, all hopes of diplomacy disappeared once the cross-LOC firing in Kargil began during the mid-1990s. The death toll , including both soldiers and civilians, was more than 30,000.

203.     In the first week of August 1998 Indian and Pakistani troops exchanged artillery fire, described by locals as heavier than that of the 1948 and 1965 wars put together. An estimated 50,000 rounds of ammunition were expended and a large number of soldiers and civilians killed.

204.     In the summer of 1999 hostility in Kargil went far beyond the now familiar annual exhange of artillery fire.

205.     When India began patrolling the Kargil heights that summer, it found to its horror that many key posts vacated in the winter were occupied by infiltrators. A patrol was ambushed in the first week of May 1999. India belatedly realised the magnitude of the occupation - which was around 10 km deep and spanned almost 100 km of the LOC - and sent MiG fighters into action on May 26.

206.     India contended that the infiltrators were trained and armed by Pakistan, and based in "Azad Kashmir" with the full knowledge of the Pakistani government - and that Afghan and other foreign mercenaries accompanied them.

207.     Pakistan insisted that those involved were freedom fighters from Kashmir and that it was giving only moral support.

208.     India ordered the jets not to stray into Pakistani territory; but those that did were shot down.

209.     The conflict ended only after Bill Clinton, the US President, and Nawaz Sharif, Pakistan's Prime minister, met in Washington on July 4, 1999.

210.     Meanwhile, the Indian Army had made significant advances, capturing vital territory on July 4. Despite the apparent efforts to mediate, the US maintained that it was not interfering in what India still claims to be a bilateral issue.

211.     Pakistan withdrew its forces later that month. However, skirmishing continued, and in August India shot down a Pakistani reconnaissance plane, killing 16.

212.     The official number of Indian troops lost in Kargil was around 500, with almost double that number of "infiltrators" killed. Nevertheless, India did not declare war against Pakistan - instead, Mr Vajpayee ambigously announced a "war-like situation".

213.     Yet this, by all accounts of soldiers and top Indian army officers involved, was a war in which India lost men engaged in hand-to-hand combat with Pakistani soldiers in the heights of Kargil - a war that could be compared with the one of 1948-49, which was limited to Kashmir, with the other border regions remaining peaceful.

214.     Thus in 1999, in a war limited to one sector, India suffered casualities within its own territory. Despite much pressure from the military and the public, the government decided not to cross the LOC. Pakistan too suffered criticism at home for limiting its war to artillery fire across the LOC and shooting down Indian aircraft.

215.     The fear of a full-scale war (with nuclear capability adding a deadly dimension), coupled with precarious economies and the knowledge of what international sanctions could do to them, may have prevailed in both countries

216.     It was formally established in 1972, after a third war between India and Pakistan in 1971. * The LOC has been a flashpoint between the two nuclear-armed countries since its foundation. Their forces have exchanged gunfire across the line for years.

217.     The Indian Line of Control fencing is a 550 km (340 mi) barrier along the 740 km (460 mi) disputed 1972 Line of Control (or ceasefire line). The fence, constructed by India, generally remains about 150 yards on the Indian-controlled side. Its stated purpose is to exclude arms smuggling and infiltration by Pakistani-based separatist militants.[7]

218.     గవర్నర్ జగ్ మోహన్ : 1990లో కేంద్రంలో బిజెపి మద్దతుతో విపి సింగ్ ప్రధానిగా వున్నారు. బిజెపి వత్తిడిపై హిందూత్వ వాది అయిన  జగ్ మోహన్ ను జమ్ము-కశ్మీర్ గవర్నర్ గా పపించారు.

235.     India will show patience with China for "as long as it takes", sources have said, three days after Beijing placed a hold at the United Nations (UN) on the listing of Jaish-e-Mohammed chief Masood Azhar as a global terrorist.

236.     This is the fourth time in a decade that China has blocked efforts at the UN to go after Masood Azhar's assets.

237.     Sources say there are issues China has to resolve with Pakistan on this matter and that India is "cautiously confident" that eventually, Masood Azhar will get listed.

238.     Sources say that 14 of the 15 members of the UN Security Council (UNSC) have supported India on this issue and that seven UNSC members also co-sponsored the resolution on Masood Azhar.

276.     భారత్ పాకిస్తాన్ మధ్య సత్సంబంధాలు వుండడం తమకు అవసరమనే  అభిప్రాయాన్ని పాకిస్తాన్ ప్రజానీకంలో బలంగా కల్పించేస్తే కశ్మీరీల సమస్యను సులువుగా దాటవేయవచ్చని  భారత్ అనుకుంటున్నట్టు కశ్మీరీలు అనుమానిస్తుంటారు.
